Recently, a two-hour transnational dialogue has attracted global attention, with Chinese Commerce Minister Wang Ventao holding a video conversation with the EU's Trade and Economic Security Commissioner, Shevchenko, and the Dutch Economy Minister, Kareman.
On the surface, this is a regular economic and trade communication, but the core issues closely revolve around two matters: rare earth export controls and the dispute over control of Anshi Semiconductor.
However, the Chinese side didn't take over. Minister Wang Wentao's position was clear, and he even aimed at the previous practices of the European side, and instead defeated the other side's army.
Pressure on the Netherlands.
Let's talk about the rare earth issue first. During the talks, the EU assumed a "victim" posture, not only maliciously discrediting China's normal rare earth export control policies, but also claiming that these policies were unreasonable and harmful.
They complain that only half of the 2,000 rare-earth export licenses submitted by EU companies ended up being approved, which directly hit the European automotive and machinery industries.
However, the EU has deliberately ignored a key fact: it is an international practice for China to implement rare earth export controls, and in order to take care of the actual needs of EU enterprises, China has already opened up a green channel.
What is even more surprising is the Anshi incident. The EU even directly blamed China, claiming that China's relevant measures "hurt Europe and even the world." It also asked China to "ease the situation" and allow China and the Netherlands to reach a "practical agreement."
To put it bluntly, it is to want China to swallow this dumb loss, implicitly acknowledging the fact that they robbed Chinese assets.
In the face of the unreasonable demands of the European Union and the Netherlands, the attitude of Minister Wang Ventao is very clear: never compromise.
China has not only dismissed the EU’s false allegations one by one, but also demanded that the EU play a positive role in urging the Netherlands to abide by the spirit of the treaty and come up with concrete solutions to the problem as soon as possible.
Although the talks eventually reached a consensus; Mr. Wang will be invited to visit Europe this week to attend the "upgraded" China-Europe Export Control Dialogue Mechanism Meeting, the two sides have not met at all on the central issue of Anselm Semiconductor.
After the call, Karemans also complained to the outside world that "China's attitude is tough," but he did not think that China companies spent more than 30 billion in real money to acquire companies that were taken away by the Dutch government for no reason. How could China easily give in?
Dutch Piracy Act and China’s Reasonable Reaction
To understand the ins and outs of this controversy, we must start with the acquisition of Nexperia.
A few years ago, China companies spent more than 30 billion yuan to acquire a controlling stake in Anshi Semiconductor in the Netherlands through legal compliance. Not only did they complete all approval processes in accordance with Dutch laws, but they also built a packaging and testing factory in Dongguan.
Cooperate with Dutch production factories: the Dutch factory is responsible for producing chips, and the China factory is responsible for packaging and testing. The entire industrial chain is operating very smoothly.
But just when the Chinese enterprise operated the Anse Semiconductor to evaporate, the Dutch government suddenly changed its face.
Earlier this year, the Dutch government, influenced by the United States, forcibly deprived Chinese companies of control over Anselm Semiconductors by administrative and legal means in order to "prevent the transfer of technology and industrial chains from the Netherlands".
Moreover, Dutch executives are now stealing control of Anselm Semiconductor and even announcing that they will stop paying employees in China, and the Dutch government is not only not stopping it, but also pushing it.
Where this approach is "maintaining national security", it is clearly naked "piracy", completely disregarding the spirit of the rule of law and the rules of free trade.
The reason given by the Dutch government can not stand, the technology and industry of the Ansel Semiconductor was originally the Chinese enterprise through legal acquisition, the Chinese enterprise thought about how to arrange the industrial chain layout, the Dutch government is not qualified to finger the foot.
And what they call “technology outflows” are unilateral speculations from the beginning to the end, without any factual basis.
Instead, the Dutch government’s forced seizure of control of Chinese enterprises has caused tangible impacts on the global supply chain.
Nexperia mainly produces automotive semiconductors. 70% of its products must be packaged and tested in China. Most of its main customers are Chinese new energy vehicle companies.
The Dutch government is so upset that not only can Anselm semiconductor products not go smoothly, but also make the procurement cycle of Chinese new energy vehicle enterprises longer, and may even affect the supply of electric vehicles in Europe.
In the face of the unreasonable behavior of the Netherlands, China's counter-measures are both legal and reasonable.
China's new rare earth export control regulations and related measures against Nexperia are all necessary means to safeguard its legitimate rights and interests within the legal framework.
And the Chinese side is also cleverly using the Dutch own logical anti-general army, the Netherlands is not saying that China will affect the stability of the global supply chain?
Now the Chinese side directly pointed out that the real undermining of the stability of the supply chain is the Dutch government's act of forcibly seizing control of Chinese enterprises.
The chain reaction behind the incident
This struggle for the control of semiconductors, the influence has long gone beyond the scope of enterprises and countries, both the Netherlands' native economy and the life of ordinary Chinese people, are involved in it.
First of all, the Dutch government is eager to negotiate with China, not because they recognize that they are wrong, but because China’s counter-reaction has eaten them.
After Anselm Semiconductor lost the Chinese market, even if the Netherlands built its own packaging test production line, it is mostly half-dead and deadly struggling, there is no development prospect at all.
What's more, the capital market in the Netherlands has been turbulent, and the Amsterdam Exchange even shows signs of capital flight.
Capital is most sensitive to political risks, and the Dutch violation of the spirit of contracts has led investors to lose confidence in the country.
The days of the European Union are also better, they wanted to promote green transition and digital upgrading, and also want to talk with China about raw material supply and market cooperation, but the Dutch case has become a barrier.
The EU had to follow the Netherlands to call China to "persuade", but in fact it couldn't come up with a substantive solution at all. The whole process only gave the Netherlands a "help" and forced China to make concessions.
But the EU has forgotten that more than a quarter of their supply chain is deeply bound to China. If there is a stalemate, only themselves will suffer.
For China, this matter is not only related to the interests of Anshi Semiconductor, but also related to the safety of overseas investment by all Chinese companies.
If the Chinese side compromises on this matter, then Chinese enterprises will invest overseas in the future and will likely become the target of arbitrary looting by other countries.
And this impact will also spread to the lives of ordinary people: Nexperia's chips are used in mobile phones, computers, smart home appliances and new energy vehicles.
If the supply chain is interrupted, the price of these products may rise, the delivery time will be extended, and everyone will buy more money and more time.
Even the funds and financial management related to semiconductors and smart cars bought by ordinary people may fluctuate due to the unstable investment environment.
However, China also holds a key advantage in this dispute.
China is not only Nexperia's largest market, but also controls the "last gateway" packaging and testing of the semiconductor industry chain.
Globally, no country can replace China's position in the field of packaging and testing for the time being. Even if the Netherlands and the European Union want to bypass China, they simply cannot do it.
Moreover, the "Foreign Investment Security Regulations" just released by China this year clearly stipulate that the legitimate overseas assets of Chinese companies must be protected, which also gives China legal support for a tough response.
conclusion
Now, the Netherlands and the European Union actually still have room for maneuver. As long as they return control of ANSE Semiconductor and return to the contractual framework to negotiate with China, a win-win situation can be achieved.
If they still hold on to the idea of "embezzling the assets of Chinese companies while forcing China to compromise," they will only lose the gain in the end.
China's persistence in this matter is not only to safeguard its own interests, but also to create a more stable and fair investment environment for global enterprises.
