U.S. Chamber of Commerce sues Trump administration to raise H-1B visa fee to $100,000

The U.S. Chamber of Commerce filed a lawsuit on October 16 about the Trump administration's raising the H-1B visa fee to $100,000 in Washington DC, saying the move would harm the interests of U.S. enterprises.

On the same day, the American Chamber of Commerce issued a statement in its official website, saying that this new measure of the Trump administration is illegal because it overrides the provisions of the Immigration and Nationality Act governing the H-1B program.

Neil Bradley, Executive Vice President and Chief Policy Officer of the U.S. Chamber of Commerce, said the new fee would make it difficult for U.S. employers, startups and small and medium-sized enterprises, to take advantage of the H-1B program, which has been determined by Congress to ensure U.S. companies of all sizes have access to the global talent they need to develop their business in the U.S.

The U.S. Chamber of Commerce was established in 1912 to represent a large number of U.S. enterprises and trade associations of different sizes, industries and regions.This is the first time since Trump returned to the White House in January this year that the Chamber of Commerce has filed a lawsuit against the Trump administration.

Before the American Chamber of Commerce filed a lawsuit, on October 3, several institutions, including the United Automobile Workers and the American Association of University Professors, filed a lawsuit in the federal court in San Francisco, California, against the Trump administration's increase in H-1B visa fees, demanding that the government be prevented from implementing this initiative.

Trump signed an announcement on September 19 to raise the cost of enterprises paying for H-1B visa applicants to $100,000, saying the move was aimed at ensuring that the U.S. introduced high-skilled talent that could not be replaced by Americans.

H-1B visa is a temporary work visa in the United States that allows U.S. companies to hire foreign professional technicians to fill job vacancies that are difficult to find in the country, mainly used by U.S. tech companies to attract highly-skilled foreign talent. U.S. media analyzes that the new high visa fees will affect technology giants such as Amazon, Microsoft, Google, etc. These companies have relied on the H-1B visa program to hire foreign employees including software development engineers. U.S. Columbia Radio reports that this program may be inappropriate because it or will encourage U.S. companies to move jobs overseas, especially in specialized fields such as research and development, and may further reduce international students who intend to study in the United States.
