The following items may not be exported without permission:

(1) Technologies and carriers related to rare earth mining, smelting and separation, metal smelting, magnetic material manufacturing, recycling and utilization of rare earth secondary resources; (Control code: 1E902. a)

(2) Technologies such as assembly, debugging, maintenance, repair, and upgrading of production lines related to rare earth mining, smelting and separation, metal smelting, magnetic material manufacturing, and rare earth secondary resource recycling. (Regulatory code: 1E902.b)

If the export operator knows that it is used or substantially conducive to overseas rare earth mining, smelting and separation, metal smelting, magnetic material manufacturing, or rare earth secondary resource recycling activities, in accordance with the "People's Republic of China" Article 12 of the Export Control Law of the People's Republic of China "and Article 14 of the" Regulations on the Export Control of Dual-Use Items ", an application for an export license for dual-use items shall be submitted to the Ministry of Commerce before exporting. No provision shall be made without permission.

The meaning and scope of "rare earth" as referred to in this announcement is "smelting separation", "metal smelting" and "rare earth secondary resources", and is implemented in accordance with the relevant provisions of the "Rare Earth Management Regulations of the People's Republic of China".This announcement is referred to as "magnetic material manufacturing" technology, refers to magnesium, magnesium, magnesium magnetic manufacturing technology.This announcement refers to technology and its carriers, including technical related data, such as design drawings, process specifications, process parameters, addition process sequence, simulation data, etc.

The term "export" as used in this announcement refers to the transfer of controlled items listed in this announcement from the territory of the People's Republic of China to foreign organizations or individuals within or outside the territory, including trade exports and transfer or provision through intellectual property licensing, investment, exchanges, gifts, exhibitions, displays, testing, assistance, teaching, joint research and development, employment or employment, consultation, etc.

3. Export operators shall apply to the Ministry of Commerce for an export license in accordance with Article 16 of the Regulations of the People's Republic of China on Export Control of Dual-use Items; When applying for export technology, the export operator shall simultaneously submit the Description of Transfer or Provision of Technology Subject to Export Control according to the requirements of Annex 1; If the technology controlled by this announcement is provided to overseas organizations or individuals located within the territory of the People's Republic of China, the "Description of Providing Technologies Subject to Export Control within the territory" shall be submitted at the same time in accordance with the requirements of Annex 2.

Export operators shall use licenses in accordance with Article 18 of the Regulations of the People's Republic of China on Export Control of Dual-use Items and other provisions, and fulfill their reporting obligations in accordance with the requirements of the licenses.

Export operators should strengthen compliance awareness, understand the performance indicators, main uses of goods, technologies and services intended to be exported, etc., and determine whether they belong to two-purpose objects. can not judge whether the objects intended to be transferred or provided belong to the objects controlled by this announcement, or can not judge whether the relevant circumstances are controlled by this announcement, can be consulted with the Ministry of Commerce.

5, no unit or individual may provide intermediary, assembly, agent, freight, delivery, customs reporting, third-party e-commerce trading platform and financial services for the violation of this announcement. may involve this announcement to control the export of goods, the service provider should actively ask the service object about the export activities are subject to this announcement jurisdiction, whether they are applying for export license or obtaining license documents; export operators who have obtained the export license for two-purpose goods, should actively show the relevant service provider license documents.

(6) Technologies that have entered the public domain, the technology in the basic scientific research or the technology necessary for the application of ordinary patents are not subject to the jurisdiction of this announcement.From the date of entry into force of this announcement, the technology that has not entered the public domain without permission to disclose this announcement to a specific object, according to Article 34 of the Export Control Law of the People's Republic of China, to be punished.

Chinese citizens, legal persons, and non-legal organizations without permission may not provide any substantial assistance and support for foreign rare earth mining, metallurgy separation, metallurgy, magnetic materials manufacturing, and rare earth secondary resource recycling activities, in violation of the requirements of this announcement, in accordance with the relevant provisions of the Law of the People's Republic of China on Export Control and the Regulations of the People's Republic of China on Export Control.

This notice shall be implemented from the date of its publication and the "List of export controls of two-use items of the People's Republic of China" shall be updated simultaneously.
