US court rules Trump administration's "birthright citizenship" restriction order is unconstitutional

On October 3, local time, the U.S. Court of Appeals for the First Circuit ruled that the Trump administration's executive order restricting birth citizenship was unconstitutional and upheld the nationwide ban of lower courts. This is another obstruction in the Trump administration's tough immigration agenda after the Ninth Circuit Court of Appeals made a similar ruling in July.

The executive order took effect on January 20 this year and requires the refusal to recognize the citizenship of children born in the United States whose parents are not U.S. citizens or green card holders. The court held that this violated the "citizen by birth" clause of the Fourteenth Amendment to the U.S. Constitution.

The Trump administration has asked the Supreme Court to consider the case. If accepted, the case will be submitted to the Supreme Court for a second time.
