Article 7 The people's police of public security organs may impose administrative coercive measures and administrative penalties on individuals or organizations that violate public security management or other public security administrative laws and regulations in accordance with the law. Article 8 The people's police of the public security organ may forcibly remove persons who seriously endanger public security order or threaten public security from the scene, detain them in accordance with the law, or take other measures prescribed by law. Article 9 In order to maintain public security and order, the people's police of the public security organs may interrogate and inspect persons suspected of violating laws and crimes on the spot after presenting corresponding certificates; After interrogation and inspection, if one of the following circumstances occurs, he may be taken to the public security organ, and with the approval of the public security organ, he may continue to be interrogated: (1) If he is accused of committing a criminal act;(2) If he is suspected of committing a crime on the spot;(3) If he is suspected of committing a crime, his identity is unknown;(4) If the items he is carrying may be stolen goods. The detention time of the interrogated person shall not exceed 24 hours from the time he is brought to the public security organ. Under special circumstances, it may be extended to 48 hours with the approval of the public security organ at or above the county level, and a record of the interrogation shall be kept. If the continued questioning is approved, the family member or the unit to which he works shall be notified immediately. If continued questioning is not approved, the person questioned shall be released immediately. After continued questioning, if the public security organ believes that detention or other coercive measures need to be taken against the interrogated person in accordance with the law, it shall make a decision within the period specified in the preceding paragraph; if the above decision cannot be made within the period specified in the preceding paragraph, it shall immediately release the interrogated person. Article 10 In case of emergencies such as resisting arrest, rioting, prison escape, seizing guns or other violent acts, the people's police of the public security organ may use weapons in accordance with relevant state regulations. Article 11 In order to stop serious illegal and criminal activities, the people's police of public security organs may use police equipment in accordance with relevant state regulations. Article 12 In order to investigate criminal activities, the people's police of the public security organ may carry out detention, search, arrest or other coercive measures in accordance with the law. Article 13 Due to urgent needs to perform their duties, the people's police of the public security organs may give priority to taking public transportation upon presentation of corresponding certificates, and give priority to passing when encountering traffic obstacles. Due to the needs of investigating crimes, public security organs may, when necessary, give priority to the use of transportation, communication tools, venues and buildings of government agencies, organizations, enterprises, institutions and individuals in accordance with relevant state regulations, and shall promptly return them after use and pay appropriate fees; If losses are caused, compensation shall be paid. Article 14 The people's police of public security organs may take protective restraint measures against mental patients who seriously endanger public security or the personal safety of others. If it is necessary to be sent to a designated unit or place for guardianship, it shall be reported to the public security organ of the people's government at or above the county level for approval, and the guardian shall be notified in a timely manner. Article 15 In order to prevent and stop behaviors that seriously endanger public security order, public security organs of people's governments at or above the county level may restrict the passage or stay of people and vehicles in certain areas and times, and may implement traffic control when necessary. The people's police of the public security organs may take corresponding traffic control measures in accordance with the provisions of the preceding paragraph. Article 16 If the public security organs need to investigate crimes, they may adopt technical reconnaissance measures in accordance with relevant state regulations and after strict approval procedures. Article 17 The public security organs of the people's governments at or above the county level may, with the approval of the public security organs at higher levels and the people's governments at the same level, implement on-site control for emergencies that seriously endanger social security and order according to the circumstances. In accordance with the provisions of the preceding paragraph, the people's police of the public security organ may use necessary measures to forcibly disperse them, and forcibly remove those who refuse to obey from the scene or immediately detain them. Article 18 The people's police of national security agencies, prisons, and labor education administrative agencies, and the judicial police of people's courts and people's procuratorates shall perform their functions and powers in accordance with the provisions of relevant laws and administrative regulations. Article 19 During non-working hours, the people's police shall perform their duties in case of emergencies within the scope of their duties. Article 23 The people's police must dress in accordance with regulations, wear people's police logos or hold people's police certificates, and maintain a strict appearance and dignified demeanor. Chapter 4 Organization and Management Article 24 The state stipulates the organizational structure and job sequence based on the nature, tasks and characteristics of the work of the people's police. Article 25 The people's police implement a police rank system in accordance with the law. Article 26 To serve as a people's police officer, one must meet the following conditions: (1) People who have reached the age of 18; (2) Support the Constitution of the People's Republic of China;(3) Have good political and professional qualities and good conduct;(4) Be in good health;(5) Have a high school degree or above;(6) Volunteer to work as the people's police. Those who fall under any of the following circumstances shall not serve as the people's police: (1) those who have received criminal punishment for a crime;(2) those who have been expelled from public office. Article 27: To recruit people's police, people's police must be recruited through public examinations, strictly assessed, and selected on the best in accordance with national regulations. Chapter 5 Police Security Article 32 The people's police must implement the decisions and orders of their superiors. If the people's police believe that there are errors in decisions and orders, they may put forward opinions in accordance with regulations, but may not suspend or change the execution of decisions and orders; if the opinions put forward are not accepted, they must obey the decisions and orders; The consequences of implementing decisions and orders are the responsibility of the superior who made the decisions and orders. Article 33 The people's police have the right to refuse to execute instructions that exceed the scope of the people's police's duties stipulated by laws and regulations, and at the same time report to the higher authorities. Article 34 When the people's police perform their duties in accordance with the law, citizens and organizations shall provide support and assistance. The act of citizens and organizations assisting the people's police in performing their duties in accordance with the law is protected by law. Citizens and organizations who assist the people's police in performing their duties and cause personal injury or property damage shall be provided with compensation or compensation in accordance with relevant state regulations. Article 35 Anyone who refuses or obstructs the people's police from performing their duties in accordance with the law and commits one of the following acts shall be given public security management penalties: (1) Publicly insults the people's police while performing their duties;(2) obstructs the people's police from investigating and collecting evidence;(3) Refusing or obstructing the people's police from performing tasks such as pursuit, search, and rescue into relevant residences or places;(4) Deliberately placing obstacles on police cars performing urgent tasks such as saving people, rescuing, chasing, and guarding; (5) Having other behaviors that refuse or hinder the people's police from performing their duties. If the acts specified in the preceding paragraph are committed by violence or threat, and the case constitutes a crime, criminal responsibility shall be investigated in accordance with the law. Article 36 The police signs, standard clothing and police equipment of the people's police shall be uniformly produced by the public security department of the State Council and managed in conjunction with other relevant state agencies. Other individuals and organizations shall not illegally manufacture or sell them. The police signs, standard clothing, police equipment, and certificates of the people's police are for the exclusive use of the people's police and are not allowed to hold or use them by other individuals and organizations. Article 37 The state guarantees the funds of the people's police. Article 41 If the people's police are disabled on duty, they shall enjoy the same state pension and preferential treatment as active servicemen who are disabled on duty. Chapter 6 Law Enforcement Supervision Article 42 When performing their duties, the people's police shall accept the supervision of the People's Procuratorate and administrative supervision organs in accordance with the law. Article 43 The higher-level authority of the People's Police supervises the law enforcement activities of the lower-level authority and shall revoke or change the handling or decision made by the authority if it finds that there is any error. Article 44 When performing their duties, the people's police must consciously accept the supervision of society and citizens. Provisions made by the people's police organs that are directly related to public interests shall be announced to the public. Article 45 When handling a public security case, the people's police encounter any of the following circumstances, they shall recuse, and the parties or their legal representatives also have the right to require them to recuse: (1) They are parties to the case or are close relatives of the parties;(2) They or their close relatives have an interest in the case;(3) They have other relationships with the parties in the case that may affect the fair handling of the case. The withdrawal specified in the preceding paragraph shall be decided by the relevant public security organs. The provisions of the Criminal Procedure Law shall apply to the withdrawal of the people's police in handling criminal cases. Article 46 Citizens or organizations have the right to report or accuse the people's police of violating laws and disciplines to the people's police organs, people's procuratorates, or administrative supervision organs. The authority that accepts reports and accusations shall promptly investigate and deal with them and inform the informant and accuser of the results of the investigation and punishment. No one may suppress or retaliate against citizens or organizations that report or accuse them in accordance with the law. Article 47 The public security organs establish an inspection system to supervise the people's police of the public security organs 'implementation of laws, regulations and compliance with disciplines. Chapter 7 Legal Liability Article 48 If the people's police commits any of the acts listed in Article 22 of this Law, they shall be given administrative sanctions; if the case constitutes a crime, they shall be investigated for criminal responsibility in accordance with the law. Chapter 5 Police Security Article 32 The people's police must implement the decisions and orders of their superiors. If the people's police believe that there are errors in decisions and orders, they may put forward opinions in accordance with regulations, but may not suspend or change the execution of decisions and orders; if the opinions put forward are not accepted, they must obey the decisions and orders; The consequences of implementing decisions and orders are the responsibility of the superior who made the decisions and orders. Article 33 The people's police have the right to refuse to execute instructions that exceed the scope of the people's police's duties stipulated by laws and regulations, and at the same time report to the higher authorities. Article 34 When the people's police perform their duties in accordance with the law, citizens and organizations shall provide support and assistance. The act of citizens and organizations assisting the people's police in performing their duties in accordance with the law is protected by law. Those who have made remarkable achievements in assisting the people's police in performing their duties will be commended and rewarded. Citizens and organizations who assist the people's police in performing their duties and cause personal injury or property damage shall be provided with compensation or compensation in accordance with relevant state regulations. Article 35 Anyone who refuses or obstructs the people's police from performing their duties in accordance with the law and commits one of the following acts shall be given public security management penalties: (1) Publicly insults the people's police while performing their duties;(2) obstructs the people's police from investigating and collecting evidence;(3) Refusing or obstructing the people's police from performing tasks such as pursuit, search, and rescue into relevant residences or places;(4) Deliberately placing obstacles on police cars performing urgent tasks such as saving people, rescuing, chasing, and guarding; (5) Having other behaviors that refuse or hinder the people's police from performing their duties. If the acts specified in the preceding paragraph are committed by violence or threat, and the case constitutes a crime, criminal responsibility shall be investigated in accordance with the law. Article 36 The police signs, standard clothing and police equipment of the people's police shall be uniformly produced by the public security department of the State Council and managed in conjunction with other relevant state agencies. Other individuals and organizations shall not illegally manufacture or sell them. The police signs, standard clothing, police equipment, and certificates of the people's police are for the exclusive use of the people's police and are not allowed to hold or use them by other individuals and organizations. Anyone who violates the provisions of the preceding two paragraphs shall be confiscated of the people's police signs, standard clothing, police equipment, and certificates illegally manufactured, sold, held, and used, and shall be detained or given a warning by the public security organ for not more than 15 days, and may concurrently impose a fine of not more than five times the illegal income; if a crime is constituted, criminal responsibility shall be investigated in accordance with the law. Article 37 The state guarantees the funds of the people's police. The funds of the people's police are included in the central and local budgets respectively in accordance with the principle of division of powers and powers. Article 38 People's governments at all levels shall include the construction of communications, training facilities and infrastructure such as transportation, fire protection, police stations, and supervision sites necessary for the work of the people's police in the capital construction plan and the overall plan for urban and rural construction. Article 39 The state strengthens the modernization of people's police equipment and strives to promote and apply advanced scientific and technological achievements. Article 40 The people's police shall implement the salary system of national civil servants and enjoy police rank allowances and other allowances, subsidies and insurance benefits stipulated by the state. Article 41 If the people's police are disabled on duty, they shall enjoy the same state pension and preferential treatment as active servicemen who are disabled on duty. If a people's policeman dies in the line of duty or dies of illness, his family members will enjoy the same state pension and preferential treatment as the family members of active servicemen who die in the line of duty or dies of illness. Chapter 6 Law Enforcement Supervision Article 42 When performing their duties, the people's police shall accept the supervision of the People's Procuratorate and administrative supervision organs in accordance with the law. Article 43 The higher-level authority of the People's Police supervises the law enforcement activities of the lower-level authority and shall revoke or change the handling or decision made by the authority if it finds that there is any error. Article 44 When performing their duties, the people's police must consciously accept the supervision of society and citizens. Provisions made by the people's police organs that are directly related to public interests shall be announced to the public. Article 45 When handling a public security case, the people's police encounter any of the following circumstances, they shall recuse, and the parties or their legal representatives also have the right to require them to recuse: (1) They are parties to the case or are close relatives of the parties;(2) They or their close relatives have an interest in the case;(3) They have other relationships with the parties in the case that may affect the fair handling of the case. The withdrawal specified in the preceding paragraph shall be decided by the relevant public security organs. The provisions of the Criminal Procedure Law shall apply to the withdrawal of the people's police in handling criminal cases. Article 46 Citizens or organizations have the right to report or accuse the people's police of violating laws and disciplines to the people's police organs, people's procuratorates, or administrative supervision organs. The authority that accepts reports and accusations shall promptly investigate and deal with them and inform the informant and accuser of the results of the investigation and punishment. No one may suppress or retaliate against citizens or organizations that report or accuse them in accordance with the law. Article 47 The public security organs establish an inspection system to supervise the people's police of the public security organs 'implementation of laws, regulations and compliance with disciplines. Chapter 7 Legal Liability Article 48 If the people's police commits any of the acts listed in Article 22 of this Law, they shall be given administrative sanctions; if the case constitutes a crime, they shall be investigated for criminal responsibility in accordance with the law. Article 49 If the people's police use weapons or police equipment in violation of regulations, which constitutes a crime, they shall be investigated for criminal responsibility in accordance with the law; if it does not constitute a crime, administrative sanctions shall be given in accordance with the law. Article 50 If the people's police infringe on the legitimate rights and interests of citizens or organizations and cause damage in the performance of their duties, they shall compensate in accordance with the provisions of the State Compensation Law of the People's Republic of China and other relevant laws and regulations. Chapter VIII Supplementary Provisions Article 51 The People's Armed Police Force of China performs security tasks assigned by the state.
