Article 2 The people's governments of cities at or above the county level shall set up relief stations for vagrants and beggars according to needs. The rescue station's assistance to vagrants and beggars is a temporary social assistance measure. Article 3 The people's governments of cities at or above the county level shall take active measures to provide timely assistance to vagrants and beggars, and shall include the funds needed for assistance work in the financial budget to ensure it. The state encourages and supports social organizations and individuals to assist vagrants and beggars. Article 4 The civil affairs department of the people's government at or above the county level is responsible for the rescue work of vagrants and beggars, and provides guidance and supervision over the rescue stations. Public security, health, transportation, railways, urban management and other departments should do relevant work within their respective scope of responsibilities. Article 5 If staff members of public security organs and other relevant administrative agencies discover vagrants and beggars while performing their duties, they shall inform them to seek help from the rescue station; disabled people, minors, the elderly and other persons with limited mobility among them, they shall also be guided and protected to the rescue station. Article 6 Vagrants and beggars who seek help from a rescue station shall truthfully provide their names and other basic information, register their belongings at the rescue station, and make requests for help from the rescue station. The rescue station shall provide timely assistance to the persons seeking help who are the objects of assistance and shall not refuse; for the persons seeking help who are not the objects of assistance, the reasons for not giving assistance shall be explained. Article 7 The rescue station shall provide the following assistance according to the needs of the aided personnel: (1) Provide food that meets the food hygiene requirements;(2) Provide accommodation that meets the basic conditions;(3) Timely send to the hospital if an emergency occurs in the station for treatment; (4) Help contact their relatives or unit;(5) Provide travel vouchers if they return to their place of residence or unit without transportation expenses. Article 8 The accommodation provided by a rescue station for recipients shall be divided into rooms according to gender, and female recipients shall be managed by female staff. Article 9 The rescue station shall ensure the personal safety of the aided personnel and the safety of their belongings in the station, and maintain order in the station. Article 10 Rescue stations shall not collect fees from aided persons, their relatives or the unit where they work, and shall not organize aided persons to engage in productive labor under any pretext. Article 11 The rescue station shall persuade the aided person to return to his place of residence or unit, and shall not restrict the aided person from leaving the rescue station. Rescue stations should take care of the disabled, minors, and the elderly who are assisted; if the address is ascertained, their relatives or unit will be promptly notified to take it back; if the homeless person is homeless, the people's government of the place where his registered residence is located shall properly resettle it. Article 12 The county-level people's government where the aided person lives shall take measures to help the aided person solve his production and living difficulties, and educate the close relatives or other guardians of abandoned disabled persons, minors, and the elderly to fulfill their maintenance and maintenance obligations. Article 13 Rescue stations shall establish and improve various systems for in-station management and implement standardized management. Article 14 The civil affairs department of the people's government at or above the county level shall strengthen the education, training and supervision of the staff of rescue stations. Article 15 If a rescue station fails to perform its rescue duties, the person seeking help may report it to the local civil affairs department; if the civil affairs department verifies that it is true, it shall order the rescue station to provide timely assistance and impose disciplinary sanctions on the person directly responsible in accordance with the law. Article 16 Assisted personnel shall abide by laws and regulations. If the aided person violates laws and regulations, he shall be dealt with in accordance with the law. Assisted personnel shall abide by various rules and regulations of the rescue station. Article 17 The detailed implementation rules of these Measures shall be formulated by the civil affairs department of the State Council. Article 18 These Measures will come into effect on August 1, 2003.
