Ministry of Commerce: Investigation into trade and investment barriers to Mexican-related restrictions on China

According to the relevant provisions of the Foreign Trade Law of the People's Republic of China and the Rules for Investigation of Foreign Trade Barriers of the Ministry of Commerce, in order to maintain the order of foreign trade, the Ministry of Commerce can investigate the trade and investment barriers of relevant countries and regions on its own.

Preliminary evidence and information obtained by the Ministry of Commerce show that according to the proposal on adjustment of multiple import duties published by the Mexican Parliamentary Communiqué on September 9, 2025, the Mexican government plans to raise import duties on products from non-free trade partners such as China, which would seriously harm the trade and investment interests of Chinese enterprises.

In accordance with the provisions of Article 36, Article 37 of the Foreign Trade Law of the People's Republic of China and Article 12 and Article 35 of the Foreign Trade Barriers Investigation Rules, the Ministry of Commerce has decided to initiate a trade and investment barrier investigation on Mexico's related restrictive measures concerning China from September 25, 2025.

1. Investigated measures and products involved

The Mexican government intends to raise import tariffs on non-free trade partners such as China, specifically in the categories of automobiles and parts, textiles, clothing, plastics, steel, household appliances, aluminum, toys, furniture, shoes, leather, paper and cardboard, motorcycles, glass and other products.

II. Investigation procedure

According to the "Rules for Investigation of Foreign Trade Barriers", the Ministry of Commerce can use questionnaires, hearings, on-the-spot investigations, etc. to learn about the situation from interested parties and conduct investigations.

c) Period of investigation

This case shall be concluded within six months from the date of the decision to announce the case, and may be extended in special circumstances, but the extension shall not exceed three months.

Interested parties may download on the website of the Ministry of Commerce's Trade Relief and Investigation Bureau's website or go to the Ministry of Commerce's Trade Relief and Public Information Consultation Room (phone: 0086-10-65197878) to find, read, copy and copy the public information on this case.

V. Comments on the case

Interested parties' comments on issues related to the filing of the case shall, within 20 days from the date of publication of this announcement, submit written opinions to the Trade Relief Investigation Bureau of the Ministry of Commerce.

VI. Submission and processing of information

Interested parties submitting comments, responses, etc. during the investigation should submit the electronic version through the "Commercial Relief Investigation Information Platform" (https://etrb.mofcom.gov.cn) and submit the written version at the same time as required by the Ministry of Commerce. The electronic version and the written version content should be the same, and the format should be consistent.

If the interested party believes that the information it provides will have a serious adverse impact after the leakage, it may apply to the Ministry of Commerce to process the confidential information accordingly and explain the reasons. If the Ministry of Commerce agrees with its request, the interested party applying for the confidential information shall at the same time provide a non-confidential summary of the confidential information. The non-confidential summary should contain sufficient meaningful information so that other stakeholders can have a reasonable understanding of the confidential information. If the non-confidential summary cannot be provided, the reasons should be explained. If the information submitted by the interested party does not specify the need for confidential information, the Ministry of Commerce will treat the information as public information.
