California consider suing Trump administration for $100,000 H-1B visa fee

On September 24, local time, the California Attorney General's Office confirmed that California was considering filing a lawsuit against President Trump's new H-1B visa regulation, which raised the cost of companies paying for H-1B temporary work visas applicants from thousands to $100,000, once sparking chaos in technology enterprises.

A spokesman for California Attorney General Bonta said that the U.S. government's move will hurt the competitiveness of enterprises and hinder the development of the United States in the fields of science and technology, engineering and medicine. Bonta said that if the policy is found to be "arbitrary and lacking reasonable basis", it may face legal challenges. The California Department of Justice is closely monitoring the implementation of this executive order and its impact to decide whether to take follow-up action.

The H-1B visa program is the main way to introduce high-skilled talent in the U.S. to professionals in science, technology, engineering and mathematics. According to the U.S. Citizenship and Immigration Services Agency, the maximum number of new H-1B visas issued annually is 85,000. Tech giants such as Amazon, Google, Tesla, Microsoft and Meta have relied on the H-1B visa program to hire foreign employees including software development engineers. The California technology industry is a major pillar of the state’s economy and taxation.

According to some analysts, the U.S. government has raised the annual fee for the H-1B visa significantly, which could lead to a dramatic rise in human costs for large tech companies. In addition, for small tech companies and startups, the human costs of $100,000 per year will be unbearable, not only preventing them from recruiting overseas talent, but also forcing them to move some of their high-value jobs overseas.
