On June 9, 2003 (May 10, 2003 in the lunar calendar), Sun Zhigang was sentenced in the first instance in the case of intentional injury to death. From June 5 to June 6, 2003, the Intermediate People's Court of Guangzhou City publicly heard the case of Qiao Yanqin, Li Haiying, Zhong Liaoguo and others deliberately injuring Sun Zhigang, a former employee of Daqi Garment Company in Guangzhou City, and issued a first-instance judgment on June 9. Defendant Qiao Yanqin was sentenced to death and deprived of political rights for life for the crime of intentional injury; defendant Li Haiying was sentenced to death with a two-year reprieve and deprived of political rights for life; defendant Zhong Liaoguo was sentenced to life imprisonment and deprived of political rights for life; The defendants Zhou Liwei, Zhang Mingjun and Lu Erpeng were sentenced to 15 years in prison and deprivation of political rights for 5 years; the defendant Li Longsheng was sentenced to 12 years in prison and deprivation of political rights for 4 years; the defendants Wei Yanliang, He Jiahong, Li Wenxing, Qiao Zhijun and Hu Jinyan were sentenced to 3 to 10 years in prison. On the same day, Sun Zhigang's case involved Li Yaohui, former police officer of Huangcun Street Police Station of Tianhe Branch of Guangzhou City Security Bureau, Zhang Yaohui, former deputy director of Jiangcun Inpatient Department of Guangzhou City Hospital, Peng Hongjun, former head of the Guangzhou City Treatment Station, doctor Ren Haoqiang, and nurses Zou Liping and Zeng Weilin were sentenced to 2 to 3 years in prison by Guangzhou City Tianhe District People's Court and Baiyun District People's Court respectively for dereliction of duty. After trial, the court found that on the evening of March 17, the victim Sun Zhigang was mistakenly detained by the police of Huangcun Street Police Station of the Tianhe District Branch of the Guangzhou City Public Security Bureau because he went out without carrying any documents. On the evening of March 18, Sun Zhigang claimed that he had heart disease and was sent to the Guangzhou City Detention Station for treatment. On the evening of March 19, Qiao Yanqin, a nurse at the treatment station, was dissatisfied because Sun Zhigang called loudly. Qiao Sui discussed with Lu Erpeng, Qiao Zhijun, Hu Jinyan and others, and instructed Li Haiying and other eight admitted patients to beat Sun Zhigang. In the early morning of March 20, the defendants Li Haiying, Zhong Liaoguo, Zhou Liwei, Zhang Mingjun, Li Longsheng, Wei Yanliang, He Jiahong, Li Wenxing, etc. beat Sun Zhigang twice in turn, causing Sun Zhigang to die on the morning of March 20 after ineffective rescue. Later, after forensic identification, Sun Zhigang died of traumatic shock due to repeated blunt violence on his back, causing extensive soft tissue damage. After trial, the court held that the defendants Qiao Yanqin, Li Haiying, Zhong Liaoguo, Zhou Liwei, Zhang Mingjun, Lu Erpeng, Li Longsheng, Wei Yanliang, He Jiahong, Li Wenxing, Qiao Zhijun and Hu Jinyan ignored national laws and jointly deliberately harmed others and caused death. Their actions all constituted the crime of intentional injury and should be punished in accordance with the law. The fact that the public prosecutor accused the above-mentioned defendant of intentional injury was clear, the evidence was sufficient, and the charge was found guilty. Among them, the defendant Qiao Yanqin instigated and organized other defendants to commit harm to Sun Zhigang, and was the main offender in this case and should be severely punished; the defendants Li Haiying, Zhong Liaoguo, Zhou Liwei, Zhang Mingjun, Lu Erpeng and others beat the victim to death twice in turn. The crimes were serious and should be severely punished; the defendants Li Longsheng, Wei Yanliang, He Jiahong, Li Wenxing, Qiao Zhijun and Hu Jinyan played auxiliary and secondary roles in the joint crime and were accomplices and should be punished in accordance with the law. However, since the defendant Li Wenxing was under 18 years old at the time of the crime, he was given a lighter punishment in accordance with the law. According to the Tianhe District People's Court and the Baiyun District People's Court of Guangzhou City, Li Yaohui, a police officer at Huangcun Street Police Station of Tianhe Branch of Guangzhou City Public Security Bureau, Zhang Yaohui, former deputy director of the Jiangcun Inpatient Department of Guangzhou City Brain Hospital, Peng Hongjun, former head of the Inpatient Treatment Station of Guangzhou City, doctor Ren Haoqiang, nurses Zou Liping and Zeng Weilin, were staff members of state agencies or persons entrusted by state agencies to perform official duties, failing to perform their duties conscientiously and were seriously irresponsible. As a result, Sun Zhigang was mistakenly detained and died of injuries at the treatment station. His behavior violated the Criminal Law of the People's Republic of China and constituted a crime of dereliction of duty. To this end, the relevant courts made the above judgments respectively.
