On January 25, 1997, the fake wine poisoning case in Huize County, Yunnan Province, which shocked the whole country, was finally tried by the Higher People's Court of Yunnan Province. With the approval of the Supreme People's Court, Li Rongping, Jiang Hongmei, Yin Guangcai, Peng Chuanyun, and Chen Jianwu were sentenced to death, deprived of political rights for life, and executed locally on the same day. The criminals Li Rongping and Jiang Hongmei were originally farmers in the sixth village of Zhehai Town, Huize County, Yunnan Province. From July 1995 to February 1996, Li Rongping and Jiang Hongmei employed Yin Guangcai and others without a production and business license to exchange edible alcohol for inferior bulk Baijiu for sales profit, which was seized and fined by the industry and commerce administration. Li Rongping and Jiang Hongmei used methanol to exchange "Baijiu" for sales in order to make huge profits, knowing that methanol was toxic. On June 15, 1996, Li Rongping and Jiang Hongmei purchased 3,300 kilograms of methanol from a chemical company. Li Rongping instructed Yin Guangcai and others to make more than 10,000 kilograms of Baijiu in bulk. Jiang Hongmei, Yin Guangcai and others sold it to Dajing, Zhehai and other townships in this county, causing 33 people to die of methanol poisoning after drinking, and more than 100 people were injured. Peng Chuanyun, a farmer in Fanjia Village, Zhehai Town, Huize County, was seized and fined by the industrial and commercial administration for illegally exchanging edible alcohol for inferior Baijiu sales in February 1996. On June 15, 1996, he purchased edible alcohol from Li Rongping for exchanging Baijiu sales for profit. Li Rongping then sold 510 kilograms of methanol to Peng Chuanyun. Peng Chuanyun used this to make more than 2,000 kilograms of Baijiu in bulk for sale and profit, causing 16 people to be poisoned after drinking, including 2 deaths. The criminal, Chen Jianwu, was originally a farmer in Luobu Ancient Town, Huize County. In early July 1996, Chen Jianwu purchased 82 kilograms of Baijiu in bulk redeemed with methanol for sale. After Li Rongping's fake wine poisoning case, the cadres of the industry and commerce department and the office informed him that the wine he was distributing had been poisoned and were not allowed to be sold again, but Chen Jianwu only identified and sealed the bulk Baijiu in the store. Afterwards, in defiance of the government's ban, the bulk Baijiu hidden in the bedroom was taken out and continued to be sold, causing one person to die of poisoning after drinking. The Qujing District Intermediate People's Court of Yunnan Province held that Li Rongping, Jiang Hongmei, Yin Guangcai, Peng Chuanyun, and Chen Jianwu were guilty of profiteering, ignoring national laws and the lives and health of the masses, and using non-edible raw material methanol to exchange and sell toxic counterfeit alcohol, causing 36 people to die of poisoning after drinking and more than 100 people to be injured. The serious consequences of their actions have all constituted the crime of producing and selling toxic food. In the criminal activities, Li Rongping and Jiang Hongmei were the organizers and commanders; Yin Guangcai actively participated in the criminal activities of Li Rongping and Jiang Hongmei, which together caused 33 deaths and other serious consequences; Peng Chuanyun refused to repent after being punished by the industrial and commercial organs for making fake wine, and continued to illegally produce and sell toxic fake wine, causing 2 deaths and 2 serious injuries, with serious consequences; Chen Jianwu ignored the government's ban and continued to sell toxic Baijiu, causing 1 person to die after drinking. The above five crimes should be severely punished according to law. In accordance with the "Decision of the Standing Committee of the National People's Congress on Punishing the Crime of Producing and Selling Counterfeit and Shoddy Food" and the relevant provisions of the Criminal Law of the People's Republic of China, Li Rongping, Jiang Hongmei, Yin Guangcai, and Peng Chuanyun were sentenced to death and deprived of political rights for life for the crime of producing and selling toxic food; Chen Jianwu was sentenced to death and deprived of political rights for life for the crime of selling toxic food. After the sentence was pronounced in the first instance, Li Rongping, Jiang Hongmei, Yin Guangcai, Peng Chuanyun, and Chen Jianwu refused to accept it and appealed. The Higher People's Court of Yunnan Province, 2nd-round Moderation, found that the original judgment was accurate, the sentencing was appropriate, and the trial procedure was legal. The ruling rejected the appeal and upheld the original sentence. It was reported to the Supreme People's Court for approval in accordance with the law.
